Welcome to Aqarat AI, a service provided by Nasser Alqahtani, a service provided under my Freelancer Certificate number FL-480036858. ("Nasser Alqahtani ", "we", "us", or "our"). Aqarat AI is a Software-as-a-Service (SaaS) platform that allows users to generate real estate marketing posts using artificial intelligence. By accessing and using our services, you ("user", "you", or "your") agree to be bound by these Terms of Service ("Terms"), which govern your access to and use of Aqarat AI.
Scope of Services
Aqarat AI provides users with the ability to generate real estate marketing posts using artificial intelligence. Our services are intended for both personal and commercial use, subject to the limitations outlined in these Terms and the specific subscription plan you are subscribed to.
Subscription Plans and Usage Rights
Aqarat AI currently is free but soon will introduce subscription plans. Your usage rights, including personal or commercial use of the posts generated through our services, are dependent on the subscription plan you are subscribed to. It is your responsibility to ensure that your subscription plan aligns with your intended use of the generated marketing posts. Please refer to our pricing page for detailed information on the subscription plans and corresponding usage rights. We reserve the right to change subscription plans and pricing at any time. Although we will typically provide notice in advance of any price increases, you will have the option to cancel your subscription if you do not agree to the new pricing.
Authorized Access and Use
You are permitted to access and use Aqarat AI solely through the website and as intended by us. You may not access or use our services in any automated manner, including but not limited to scraping, employing browser extensions, or utilizing any other methods that may put excessive strain on our computing or hosting resources. You are also prohibited from using the generated marketing post or outputs for the purpose of training artificial intelligence models or creating a competing or similar service.
Copyright and Intellectual Property
The legal landscape surrounding the copyright and intellectual property rights of AI-generated posts is still evolving and may be unclear in certain jurisdictions. To the extent permitted by applicable law, we grant you the rights to use the posts generated through Aqarat AI in accordance with your subscription plan. However, we make no representation or warranty regarding the uniqueness of the generated posts.
Data Storage and Deletion
While we strive to maintain the security and integrity of the data and posts generated through our services, we cannot be held responsible for any loss of data or posts that may occur. In the event that a user cancels their subscription, we reserve the right to delete any data or posts associated with the user's account. We recommend that users regularly back up their posts marketing posts and data to ensure its preservation.
Indemnification
You agree to indemnify, defend, and hold harmless Nasser Alqahtani, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of Aqarat AI, including, but not limited to, claims related to copyright infringement or intellectual property rights.
Acceptable Use
You agree to use Aqarat AI only for marketing posts that are appropriate and lawful. You may not use our services to create, promote, or disseminate any posts that:
a. Contain sexually explicit or pornographic content;
b. Promote violence or hatred towards individuals or groups based on race, ethnicity, religion, gender, disability, or any other protected characteristic;
c. Violate any applicable laws or regulations, including but not limited to copyright, trademark, or intellectual property rights; or
d. Are otherwise deemed inappropriate by Nasser Alqahtani in its sole discretion.
We reserve the right to remove or refuse access to any posts that violate these Terms, and may terminate your access to Aqarat AI if you are found to be in violation of these Terms.
Governing Law and Jurisdiction
These Terms and your use of Aqarat AI are governed by the laws of Saudi Arabia. You agree to submit to the exclusive jurisdiction of the courts of Saudi Arabia to resolve any disputes arising out of or relating to these Terms.
